Terms of Service
You are engaging Jessica Fox, as an independent contractor to perform work as described in the package(s) or service(s) you have purchased. In the event access to your website or accounting software is necessary, you hereby authorize Jessica Fox access and “write permissions” to all directories and files of your account with any other third party hosting provider, as well as permission to install any necessary WordPress plugins for maintenance and security.
Jessica Fox does not assume any responsibility or liability for the content of the websites she manages, maintains and/or hosts.
Pricing & Payments
All prices appearing on this site are subject to change without notice. Once a client of ours, you authorize Jessica Fox to charge the payment method you submitted for all the invoices generated for the services rendered. In order to cancel your recurring payment or change payment method, simply contact us in writing at least 5 days prior to your payment’s due date.
Invoices more than 5 days late will incur a late fee and all work will stop until your account is brought current.
Jessica Fox shall not incur any liability or penalty for delays in the completion of the project due to actions or negligence of client, delayed response to requests, unusual transportation delays, unforeseen illness, or external forces beyond our control. If such event(s) occur, it shall entitle Jessica Fox to extend the completion/delivery date, by the time equivalent to the period of such delay.
Cancellation & Refunds
Cancellation of any monthly recurring service can occur at any time by providing written notice by e-mail or mail at least 5 days prior to the next billing date. No refunds are available after your purchased package or service has been started, unless otherwise specified and authorized by Jessica Fox.
Refusal of Service
Jessica Fox reserves the right to refuse service to any individual, company, website, or blogs that contain offensive, obscene, hateful, malicious content or any other reason.
Third Party or Client Page Modification
With a WordPress-based website, client will independently edit or update his or her web pages after completion of the site, unless otherwise agreed upon in this agreement by client and Jessica Fox. If anyone other than Jessica Fox or her subcontractors attempts to update the web site and damages the design or impairs the ability for the web pages to display or function properly, time to repair the web pages will be assessed at an hourly rate of $80 per hour. There is a one-hour minimum.
Limitation of Liability; Disclaimer of Warranties
Although there are limitations to the guarantees we can provide, your satisfaction is very important to us. Please read and understand our limits of liability before ordering services.
We do not guarantee, represent, or warrant that the functions contained in these webpages or the Internet website will meet the client’s requirements or that the operation of the webpages will be uninterrupted or error-free.
You expressly agree that your use of, or inability to use, the functions contained in these webpages or the Internet website is at your sole risk. The functions of the webpages and the Internet website created for you are provided “as is” and “as available” for your use, without warranties of any kind. The entire risk as to the quality and performance of the webpages and website is with client.
To the extent not prohibited by law, in no event will Jessica Fox be liable to the client or any third party for any damages, including, but not limited to, any lost profits, lost savings, loss of data, business interruption, or incidental, consequential or special damages arising out of the operation of or inability to operate these webpages or website, however caused, even if Jessica Fox has been advised of the possibility of such damages.
Jessica Fox does not represent, guarantee or warrant that the functions contained in these webpages or Internet website will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusions, and Jessica Fox disclaims any liability relating thereto.
This Work Statement Agreement is governed by the laws of Florida without giving effect to its conflict of laws provision. You expressly agree that exclusive jurisdiction for any claim or dispute with Jessica Fox or relating in any way to your use of the created webpages or Internet website resides in the courts of the State of Florida.
Please note that by submitting your payment, you are agreeing to all of our terms of service as they are written here. Jessica Fox reserves the right to change or update these terms at any time without prior notice. The user of this site agrees to the terms of this agreement on behalf of his or her organization or business. This Agreement constitutes the entire understanding of the parties. Any changes or modifications thereto must be in writing and signed by both parties.
This contract cannot be transferred to anyone else without our permission. This contract stays in place and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place. Although the language is simple, the intentions are serious and this contract is a legal document under exclusive jurisdiction of the courts of Florida.

Additional Terms for WordPress Care Plans:
Our WordPress website maintenance packages are preventative care, like auto insurance. We do our best to prevent issues from occurring. We cannot guarantee that your website will not be hacked (no one can). In the event that your website has a major issue, we will restore a backup from the last working point at no extra cost. If the site breaks as a result of your adding content or updating software, etc. yourself, you will be responsible for any additional time that may be incurred in order to repair the site.
All of our support time hours are offered on a use-it-or-lose it basis. No time can be carried over from one month to the next.
Site testing- A comprehensive site test is not practical after every update. We take a quick look to make sure your site is still working, as well as a spot check on certain functional areas if they may have been impacted by a plugin update.
We are not responsible for plugins or themes abandoned by their developers that stop working or are incompatible with the current version of WordPress. Repairs to the site and/or the research and installation of an alternate plugin due to this will be billed at the then current hourly rate for Lite and Basic plan subscribers and will count against your plan’s Priority Support Hours for Plus and Premium plans subscribers.
Premium plugins and themes: We will update premium plugins and themes for which you have a current license. If not, we will ignore those plugins. We are not responsible for the cost of renewing any premium features that your website has.
Premium Plan includes monthly Performance check and report. This does not include any work needed to implement the recommendations in the report.
Premium Plan includes a monthly SEO Ranking Report. This does not include making SEO changes to your website to improve Search Engine Rankings.
Hacking assistance service in Premium Plan does not include cleanup/repair of hacking or malware that occurred before you signed up for the plan.
